1. Acceptance of Terms
By accessing and using FounderEngine ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.
2. Description of Service
FounderEngine provides AI-powered tools and resources to help entrepreneurs and founders build, validate, and grow their startups. The Service includes but is not limited to:
- AI-powered business advisor and chat assistant
- Personalized startup journey roadmaps
- Business planning and validation tools
- Document generation and templates
- Progress tracking and analytics
3. User Accounts
3.1 Account Creation: To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration.
3.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3.3 Account Termination: We reserve the right to suspend or terminate your account if you violate these Terms of Service or engage in fraudulent or illegal activities.
4. Subscription and Payments
4.1 Free Plan: FounderEngine offers a free plan with limited features. No payment information is required for the free plan.
4.2 Paid Plans: Paid subscriptions (Pro and Enterprise) provide access to additional features. All fees are exclusive of applicable taxes unless otherwise stated.
4.3 Billing: Subscriptions are billed on a monthly or annual basis. Billing begins immediately after your free trial period (if applicable) ends.
4.4 Cancellation: You may cancel your subscription at any time. Cancellations will take effect at the end of your current billing period.
4.5 Refunds: Refunds are provided on a case-by-case basis at our discretion. No refunds are provided for partial months of service.
5. Acceptable Use
You agree not to:
- Use the Service for any illegal or unauthorized purpose
- Violate any laws in your jurisdiction
- Infringe on the intellectual property rights of others
- Transmit malware, viruses, or any malicious code
- Attempt to gain unauthorized access to the Service or related systems
- Use automated systems (bots, scrapers) without our explicit permission
- Harass, abuse, or harm other users
- Reverse engineer or copy any part of the Service
6. Intellectual Property
6.1 Our Content: All content, features, and functionality of FounderEngine, including but not limited to text, graphics, logos, and software, are owned by FounderEngine and protected by copyright, trademark, and other intellectual property laws.
6.2 Your Content: You retain ownership of any content you create using the Service. By using the Service, you grant us a limited license to use, store, and display your content solely for the purpose of providing the Service.
6.3 AI-Generated Content: Content generated by our AI tools is provided "as is" for your use. We make no claims of ownership over AI-generated content created for you.
6.4 Data Usage for AI Improvement (Free Plan): If you are on the Free plan, you acknowledge and agree that anonymized and aggregated versions of your interactions with our AI (such as prompts and responses) may be used to train and improve our AI models and services. This data is anonymized and cannot be used to identify you personally. Paid plan users may opt out of this data usage.
7. AI Services Disclaimer
Our AI-powered tools are designed to assist and provide suggestions, but they should not be considered as professional legal, financial, or business advice. All AI-generated content should be reviewed and verified by qualified professionals before making business decisions.
FounderEngine is not responsible for any business decisions made based on AI-generated recommendations.
8. Privacy
Your use of the Service is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your personal information.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FOUNDERENGINE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

You agree to indemnify, defend, and hold harmless FounderEngine and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

We reserve the right to modify these Terms of Service at any time. If we make material changes, we will notify you by email or through a notice on our platform. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
